Patent Maintenance Review Capacity Estimator

This estimator calculates how many patent-maintenance records a team can review during a defined working period and compares that capacity with the pending queue. It is useful for IP operations teams tracking fee windows, ownership data, entity status, payment instructions, or other maintenance tasks across a patent portfolio.

The result is an operational capacity estimate, not a determination that a patent is legally compliant. USPTO maintenance obligations vary by patent type and timing, so teams should verify each patent against current USPTO records and payment-window information.

1. Set the team size

Formula:

Period capacity = Reviewers × Reviews per reviewer per day × (Utilization ÷ 100) × Working days

Reviewers = people assigned to the review
Reviews per reviewer per day = average completed records per productive day
Utilization = share of working time available for review, percent
Working days = days in the planning period

Assumptions: The model assumes average throughput is reasonably stable during the period. Legal sufficiency and USPTO deadline status are outside the capacity calculation.

What the result means

A higher capacity indicates the team can process more patent-maintenance records during the selected period. Backlog coverage below 100% signals that the current queue is larger than modeled capacity.

At these assumptions, the team would not fully clear an 800-record queue within 18 working days.

Does this estimator determine whether a patent maintenance fee is due?

No. It estimates review workload capacity only. Confirm actual payment windows and patent status using current USPTO information.

Should utilization be set to 100%?

Only if reviewers can devote essentially all available working time to these reviews. Most teams use a lower figure when research, meetings, escalations, and administrative work consume time.

What should count as one review?

Use a consistent unit, such as one patent record checked through your defined review checklist. If complex cases take much longer, use a lower average review rate.

What happens if the queue is smaller than capacity?

Backlog coverage is capped at 100%, and the remaining queue is shown as zero. Excess capacity can be interpreted as room for new work or additional quality checks.

How is this different from a compliance cost estimator?

Capacity focuses on how much work the team can complete. A cost estimator converts labor and other resources into monetary expense.
